It looks like a USC alum has been just as indignant regarding the June 2010 NCAA sanctions placed upon USC as we here on Conquest Chronicles have been. And get this: he's a legal analyst. Get MORE of this: HE'S GOING AFTER THE NCAA, and specifically- Dr. Josephine R. Potuto.
Did you guys realize her three 3-term committee limits had been used up? We already know the lies she told congress back in 2004 regarding Jeremy Bloom, so- what Mr. Joe Shell of Dana Point, CA has come up with is a 130 page 3/4-inch thick briefing binder that he's sent to numerous Congressmen who sat on that hearing- as well as new-NCAA President Mark Emmert and new Director of Enforcement Julie Roe Lach regarding ex-USC Running Backs Coach Todd McNair's treatment during USC's hearing before the NCAA Commmittee On Infractions in January 2010.
This should be a doozy. The other Congressmen who've received this gift from this formidable Trojan are: Darrell Issa (Vista, CA - on House Oversight Committee) and David Dreier (San Dimas) Chair of the powerful House Rules Committee.

Shell says. "The NCAA appears to believe the rules do not apply to them. They are agenda-driven. They decide the outcome, as they did with USC, and then they put together whatever they need to reach that outcome."
"At the end of the day, the NCAA felt it had to go out and destroy Todd McNair to show a lack of institutional control on the part of USC. And that’s what it did."
Two other issues are play in here, Shell says. During the USC investigation, and without a vote of the membership, the NCAA changed its appeals rules making it much harder for anyone to appeal an infractions finding. "I think they knew they had the thinnest of cases to do what they were going to do to USC and McNair," Shell says. "And they were getting ready for it."
It was a pleasure to read that article because it so cogently summarized so many ideas that I seen expressed almost exclusively on message boards and web-based media (much of it on this site). The guy who’s taking this to congress (Joe shell) really gets it. He can communicate it. And he can back it up. You can’t predict the outcome of a process like this, but I do believe that our collective voices will finally be heard.
We may never know the extent to which ideas expressed on this site and others (notably USCfootball.com) contibuted to Mr. Shells understanding of the case against the NCAA. Perhaps a little. Perhaps only as a show of support. Or perhaps not at all. But an open discussion of ideas has always been a powerrful tool to those who would make the world better, and often the best ideas rise up from humble origins. I’d like to express my personal gratitude to Paragon, the other CC staff members, and regular posters who conspire together make Conquest Chronicles such a high quality forum.

I’m thinking this new Congressional briefing by Joe Shell “might” have some influence in our appeal. Here’s the thing: I’m not sure whether or not his briefing gets past Congressional staffs, I mean- who’s to say whether or not there will be a Sub-committee review, much less hearing on the matter pertaining to Potuto. Shell’s interest in getting to the “underbelly”- as it applies to Mission Statement, Core Mission, & Core Values, which in turn leads to “tax-exempt” status in the long run? He’s definitely stated he’s going for the jugular- which is totally fine by me.
The crux of where he’s at is that he’s been able to make President Emmert and Director Lach aware of his intentions. This is where this might carry some weight at USC’s Appeal.
The best news from this is that it’s coming from an “outside” source, rather than USC directly. The fact that he’s ruffling feathers by circulating his briefing to many higher-ups has me licking my chops.

Bix, I can't offer much insight into this one..
This approach appeals to me because this isn’t something from USC about USC. It’s about NCAA corruption, and it specifically addresses some issues which were raised previously by a congressional subcommittee. As I read it, the NCAA essentially made assurances about due process, and then proceeded to ignor them. McNair would seem to have more at stake than USC as he was most visibly victimized by the NCAA’s abuse of due process. IMO, this is something that a congressional subcommittee SHOULD care about, especially since they are the only ones who have oversight authority over the NCAA.
I do not have an opinion about how this will effect USC’s appeal. I believe the deck is still stacked against USC, and I would expect the Appeal Committee to judge the case based on USC’s argument that “that the penalties imposed are too severe for the violations identified and are inconsistent with precedent in similar cases.” I don’t see much else being relevant, but nothing the NCAA does makes much sense. The organization is without direction, and its leadership is abysmal.

I’m more than comfortable you or any of the CC managers writing about anything regarding our beloved Trojans, especially as it pertains to the corruption of the NCAA- even if it has been written by any of our regulars in a Fanpost/Fanshot before then.
You guys have Conquest Chronicles rolling, and I love this blog- you, DC, Joey, and Julio. Not to mention all of our CC-regulars.

But there is one Potuto recommendation in the article that Shell characterizes as "truly scary." And obviously a shot at former USC basketball player O.J. Mayo, and others, who refuse to talk to NCAA investigators.
We’ll quote it here: "When a former student-athlete is being investigated for the commission of a violation while a student, what additionally should be considered is treating the failure to respond to the allegation as an admission by silence of that violation."
There you go. Good old due process—in the NCAA or North Korea? You’re guilty until proven innocent—and you must testify against yourself. And to an organization that you’ve never, as a student-athlete, voluntarily joined.

Here’s the what: The complexities of the various enforcement of alleged infractions committed by either institution or player-athlete is enormous, nonetheless- what I am about to write strongly considers such difficulties.
If the quote, “When a former student-athlete is being investigated for the commission of a violation while a student, what additionally should be considered is treating the failure to respond to the allegation as an admission by silence of that violation”, is extracted from the COI’s Final Report against USC, then I would also like to seek that wording omitted from it. Not only does it fearfully wade into new-precedent waters, it would undermine the very fabric of democratic obligations and principles that institutions should be granted, as members of the NCAA. It’s a blind-side hit to fair and equitable due process for all member institutions.
If the NCAA wants to dictate draconian due process rules, it should at least inform it’s members that it’s about to rain- instead of outright PISSING ON THEM?
Now, if it’s difficult to encourage or demand ex-student/athlete participation for interview- they should either GET subpoena-power or craft bylaw legislation to rectify it (for the benefit of all parties concerned) in the future. This wording of Potuto comes from purely fascist behavior and disposition.
