suing Kiffin. Maybe Pola could be sued, but all Kiffin did was offer a guy a job. As far as I know Kiffin isn’t bound by any anti-tampering rules. Maybe he could be sued for tempting someone to breach their contract.

Zoulou isn't far off the mark

When I made a crack about homerism yesterday, this is what I’m talking about. Homerism means a delusional loss of a grip on reality. A homer is the kind of guy that screams “pass interference” when there was clearly a nice play made by the other club. Homers scream about getting ripped off by refs. Homers make accusations of other programs with no basis to do so. Homers won’t admit when their own team sucks or when their own coach or players are boneheads.

Maybe this isn’t BruinsNation or NDNation level homerism, but it’s homerism nonetheless. People need to be rational and realize that it’s not good for SC to look like this.

He wasn’t my choice but he is ours and I will support him. You want to buy into what others say w/out all the info you’re free to do that.

And I definitely don’t buy into everything negative said about Kiffin, that’s not true.

I think Kiffin gets a lot of garbage from Bruins Nation types. I think a lot of the junk he gets is completely unfair.

I also think that often, he perpetuates some of this crap. You have to admit that he does.

The biggest thing I dislike is the “all or nothing” garbage people fall into. Defending Kiffin non-stop unconditionally (SC homerism) or ripping him non-stop unconditionally (other homerism). It is what it is- he has great potential and I think he’s a good guy. Writers that rip on him and call him a “brat” are idiots. At the same time, though, it seems unwise to unconditionally defend a guy when he makes choices that make SC look bad.

Is the MSM biased against Kiff and USC? oh, hell yeah

Because informed opinions are not aligned with yours, does not make these commenters homers. Coaches jump jobs more often than John Stamos gets laid. Kiffin made a great move to help our football team win. The Titan lawsuit is primarily a PR play. The majority of the MSM will always spin their reporting into an anti-Kiffin/USC theme.

That is not homerism. That is opinion supported by a wealth of supporting evidence. It just so happens to differ from your opinion.

Since you bring him up, Zou would be an example of the former. He brings up the legal implications as he sees them and debates.

An example of the latter is b.o., who’ got his panties in a bunch over protocol and appearances. Most of us have disagreed but he can’t get over himself.

Definitely not interested in killing debate, especially amongst Trojans, and I’d hope that everyone who wears our colors here at the end of the day throws ALL their support towards this school and program. I’m one of the dudes who has Kiffin’s back, but I don’t mind him getting called out if a.) it’s not some outsider trying to stir shit and b.) it’s reasonable and coming from a good place.

Pola is in breach

Clear and simple. Read the allegations and the contract. The complaint does a good job of alleging that.

Paragraph 14 and on is conjecture, yes, they allege Kiffin knew the details of Pola’s contract without providing any facts, but when pleading in most cases, you don’t need to prove your claim, you simply need to allege enough elements to survive a motion to strike. That’s prolly where USC and Kiffin will have to attack the pleading, then Tennessee prolly will counter that clauses in Pola’s contract are standard form clauses in NFL contracts and Kiffin, as a former NFL coach, knew or should have known about the clauses.

That it is customary in the NFL to approach a team before contacting a coach under contact is possibly admissible. Custom generally is admissible for certain things, but I have no idea what Tennessee evidence law is regarding contracts.

I really have no idea if this lawsuit will survive a motion to strike, but Tennessee is in a friendly jurisdiction (Tennessee courts), and either way USC will have to pay lawyers money simply to respond.

Even worse is the PR hit USC is taking. This is very serious. The NFL is a very litigious league, and I’m guessing there is a chance that USC lets Pola go back to Tennessee because of the shitstorm it has caused.

1) the potential damages are negligible, even if treble are awarded. Tenn will have to prove damages, and the value on Pola is the value of his contract. What’s a young Asst RB coach make, maybe $400k/yr? So, USC at worst gets hit with a $1 mil or so damages claim.

2) Pola will almost certainly counter-sue for breach of contract for some reason or another. Typical counter measuer.

3) There is no proof that USC read Pola’s employment contract, which was certainly confidential between Pola and Tenn.

4) This is a publicity stunt because the Titans are embarrassed at losing a star Asst to a COLLEGE team. A COLLEGE team is bullying an NFL team. Yes, it’s a PR hit to the Titans, not USC. The Titans are the laughing stock of the NFL right now.

You say Kiffin f’d up big-time. I say Kiffin hit a big-time homerun at the expense of a butt hurt NFL franchise.

1.) This will never make it to trial.

2.) Doubt it. First, Pola looks like he is in clear breach. What is his counter claim?

3.) Don’t need to read it. Have to prove they knew of it. That’s the highest hurdle to jump.

4.) I’d say they are pissed at losing a coach days before training camp.

Folks, this is what comes with Lane Kiffin.

If you’re trying to say Kiffin doesn’t know the tenets of a pro contract, it isn’t going to fly. He had one himself, not too long ago.

I’m not an expert on labor laws, but Pola was under contract. Kiffin, USC and the entire rest of the universe knew it. I don’t know if it’s tampering when outside of NFL to NFL team contact, but even if it turns out it isn’t (and I wouldn’t bet it isn’t), quite frankly it’s bush-league to not ask permission to talk to a coach already under contract.

I know you guys desperately want to believe in your school, team and coach, but seriously – at what point (if there even is one) would you sit back and think “This is my school, and people are trashing it from within. I want USC’s honor back!”?

Wins are great, and lots of wins are better, but what are you guys willing to give up to get them? You’ve already seen what happens when you cut corners and get caught; when do you decide integrity trumps wins?

I’m asking this in all seriousness: deep down, is anyone not the least bit pissed that USC, fairly or not, is now considered a dirty program? And by pissed, I mean at school personnel, not the folks now looking down on USC.

Knowing the result, would you guys (and ladies) do it all over again?

I haven’t done any research, so off the top of my head I can’t figure out where the “few others” are- as it pertains to the Carroll-era of USC sports. Can you?

Let’s define dirty program: A program that has players being paid and/or coaches involving themselves in “NCAA investigation” type behavior. (if that’s alright with you, if not- provide your own and name them)

As a student and legacy of the school

I do care deeply about the school’s reputation, especially in regards to academics, but a lot of the stuff that’s out there right now is really just a ton of B.S. Do I like the fact that the NCAA just concluded a 4-year investigation in regards to a “lack of institutional control?” Of course not. But ‘SC is down right, and a lot of people are just using this as an opportunity to kick the program when it’s down. Not that it doesn’t a warrant a few kicks here and there (several individuals screwed up royally), but it’s getting to the point where it’s pretty excessive.

There are some who call ‘SC “the most scandalous program in modern collegiate athletics.” And to be honest, they’re simply just Westwood fucks preoccupied with ‘SC instead of their own football program that’s been swimming in mediocrity for over a decade. None of care what they say. ‘SC is the west coast version of the Yankees when it comes to college football. People love to take shots, and they’re doing that. I could care less.

It’s important to remember, though, that there’s a difference between perception and reality. Granted, it’d be nice if ‘SC didn’t have the reputation of being a “dirty school,” but whatever. I’m not going to be having sleepless nights simply because the people in Westwood, South Bend, and Knoxville, think it’s a dirty program. Whatever. The facts are facts, and the NCAA found that Reggie Bush took gifts. One guy was named in the report (in regards to football).

I don’t care about perception. It’d be nice to be perceived better, but it is what it is.

But perception does matter. It matters when a constant stream of shit makes my university look bad.

You are right- I could care less what a bunch of imbecile homers from other parts of the country think. I know my alma mater is an outstanding institution, and I know it has a proud heritage (one that it definitely deserves).

That being said, stuff like this makes USC look bad not just to homers- it makes SC look bad to everyone.

That’s not good. Perception does matter, because often, when people perceive something’s wrong, that’s because it IS.

  1. class last year and off to a rip roaring start this season. Maybe you are overvaluing the perception of our competitors and their fans, and the media who has cast USC as the Evil Empire and PC as Darth Vader.

The perception of current players, future players, students, alums, USC fans, etc seems quite positive despite the onslaught of negativity. Ever heard the expression, “don’t worry about what others think because it’s out of your control. just worry about yourself?”

I'm pissed.

I don’t think SC “cut corners” in the past. I think they certainly did with basketball. Mike Garrett and Tim Floyd screwed up bigtime with basketball. There’s no question that OJ Mayo was cutting corners.

Reggie Bush’s stupidity had nothing to do with his choice to play at USC or his performance at USC. That wasn’t “cutting corners.” Carroll hired an extra coach that had little or no impact. In fact, the team stunk even worse that season. Big wow. Even if that extra coach had been incredible he would’ve had little or no impact.

I don’t buy that the football program “cut so many corners.”

However, I’m aggravated that Mike Garrett continued to make choices and say things that made SC look bad. I am aggravated that Kiffin would continue to make unscrupulous choices that make SC look bad.

Yes, sometimes perceptions don’t matter and it’s better to stand up and fight and rebel and be your own man and stand out. I guess that matters if you’re Abe Lincoln.

Other times, though, perceptions do matter. The kid who dyes his hair and puts in lip rings is being a contrarian idiot, rather than being an individual leader. He looks like a dork. And SC has gone and gotten the equivalent of a raunchy tramp stamp and a nose ring with a move like this. Even if Kiffin and SC’s intent was perfectly clean and honest here, they had to have known it could make them look horrible.

I don’t like how it makes my school look, and it’s obnoxious to hear a bunch of people respond with a “F THE MAN” attitude about it.

I like what you guys think and I enjoy the writing on this site. It’s frustrating, though, to see stuff legitimately come up that makes SC look stupid.

Take Garrett’s comment to the boosters, for example.

Garrett was largely right and we all know it. The idiotic comments in that report about SC’s culture at practices. The stupid comments around college football about SC cheating. The ridiculous accusations against McNair. Inane crap written by people who are envious of SC.

But it was a dumb choice to say that because some of the things in the report were not envious of SC. They were the facts. OJ Mayo should have never come to SC. It was obvious it was sketchy and everyone knew it. Reggie took money and benefits and lied and as dumb as the rules are, they are the rules… and SC should’ve caught it if students at SC at the time could even tell Reggie had some pretty fancy earrings and a pretty nice car.

Either way I guess my point is this. I respect other SC fans and I love this school, and people need to realize how important perception is.

Perception is what turned SC into an academic powerhouse. Bringing in Sample and other leaders and academics told the world that SC was serious about being the best of the best, not just about being a school with a “jocks and rich kids” reputation. SC is now one of the best out there and they did it by making it abundantly clear that academically they were out to be leaders and do it the right way. I don’t see why football can’t do the same thing.

It's called tortious interference with a contract

And, despite the 13th Amendment and its prohibitions, an employer can enjoin someone whose skills are unique enough from being employed by ANYONE. He’d have to sit out the rest of his contract.

Anyhow, probably not going to happen but there is at least some legal theory.

USC could remove to federal court based on diversity. That’s probably the best thing to do at this point but I can’t be for sure, or say sorry or settle. Not sure what TT wants or is trying to prove at this point.

Believe me when I say this, I want Coach Kiffin to do well and be successful beyond all measurables and expectations. He’s a walking negative ball of energy, though.

Let’s be amicable with this and pay for Pola’s 1st year as punitive damages. I’m hoping TT will be amenable to it and USC Legal is hard at work working on the settlement.

Coaches under contract leave all the time. Deciding to file suit in a situation where this is rarely done is a desperate PR move. Even if they win, the maximum ‘damage’ Kiffin/Pola could have caused would be paltry thousands. The lawsuit itself is purposeless; the Titans are trying to cash in on Kiffin hatred.

This is clearly being pushed by Tenis-ee Alums with Bud Adams Approval

Typical preliminary pleading, claiming the Tort, SC should be first up at the plate with Motions for discovery, which will take us waaaaay into the season.

This could and may very well turn into a pissing contest, cooler heads will of course try to settle this, however; it depends on who and how many UT alums are pushing on Adams. This may be their only chance to Crucify Kiffin, so expect the PR for at least a month.

Not really much of case, breach, Tort (have to prove it up though) Kiffins knowledge of the contract particulars…gonna’ be hard even for Shapiro, and Pola ain’t gonna’ offer any help.

Sounds nasty simply because of all the negative press Kiffin and USC have received lately, but this is not ground shattering case from a legal standpoint.

Opinion of a non-USC and non-Tennessee fan:

I am an attorny, but not a fan of either USC or Tennessee. I looked at the Complaint and, provided the Titans can prove constructive or actual knowledge of the contract terms by the defendants, this is a viable case. I assume the defendants will move to dismiss based on that ground, but the court will likely allow discovery on the issue since it is an issue of fact. Of course, the fact it is in a Tenn. state court doesn’t help, but it shouldn’t be a deciding factor since it will be scrutinized nationally.

The interesting part about the lawsuit is that Kiffin’s “course of conduct” with past coaches and contracts is relevant. The Titans can get discovery of how Lane handled previous contract situations because his intent and wrongful conduct are in dispute (not to mention his credibility/character as with every witness). Things could get ugly if the defendants can’t get it dismissed and don’t settle.

USC needs this to go away. If it wins the motion to dismiss, great. Otherwise, they will likely settle.

BTW – Fisher and the coaching staff don’t have to devote any significant time to pursuing the case. It is all in the hands of the attorneys now.

Also, not only is Kiffin’s past in play here, but it is likely the reason the suit was filed. Everyone knows another NFL owner thinks he is a “liar” (if I remember the allegation correctly). Plus, there are many other instances of Kiffin ruffling feathers within the group of top-level NFL and NCAA coaches: UT coaches and players, discourse with SEC coaches, etc. He has had a very short career (relatively) and no on-the field accomplishments for others to be jealous of, so you wonder why he gets on so many nerves. If it is anyone other than Kiffin, this is probably worked out informally with a phone call.

Kiffin may (or may not) be a good coach, but its clear that a lot of other coaches just don’t like him regardless of his record.

Tortuous interference with contracts is a serious cause of action.

Difficult to prove, and often it’s a claim that’s thrown in with others, you rarely see tortuous interference with contracts as stand alone claim.

But this is not an insignificant claim. I’m guessing that the Titans just want to prevent Pola from going to USC. And they just may do that.

What damages?

While I agree that Pola’s departure 7 weeks before the season starts is a pain in the ass for the Titans, I don’t see much in the way of damages. After all, he was a RB coach and they will get an adequate replacement. Pola’s departure should not effect their TV revenues, or their revenue sharing fom the league. How about the gate revenues? I think most people who follow the NFLwould concede that RB coach is not a major factor in determining whether or not they will attend a game, but if Tennessee claims that his departure had an adverse impact on attendence, I’m sure there are statistics that will be able to determine if this was likely the case. His departure won’t effect merchandize sales much either.

Of course, if the team sucks, they will try to blame it all on Kiffin, LOL. Maybe they will tank the season to validate their claims. It all comes down to priorities. In the NFL, there is only a very loose coorelation between on-field performance and revenue. There is even a looser correlation between length-of-employment-of-RB-coach and on-field performance. The whole arguement is ridiculous. Get over it, ladies.

Means they already have Pola’s replacement on staff. Have a hard time thinking they will have a hard time finding a replacement for whoever that is, I’m sure the fax/e-mail resumes have been humming ever since.

Honestly, this will settle soon for little money. It was all a PR stunt. I’d almost like to see USC fight it, but Pat Haden will take the high road. Pay Tenn $500k and make this story go away with KP safely on campus.

Does the lawsuit do more harm to Tenn than good

1) Can/will USC ban Tenn representatives from USC Pro Day? Will the NCAA even allow USC to have a Pro Day?

2) Might USC players take offense to the Titans lawsuit against USC and avoid playing for Tenn?

3) Will future Titans coaching candidates be less inclined to go there knowing that they have a history of suing their coaching staff?

No way either of the first two happen

No school is going to intentionally reduce exposure for their athletes, and no player should let this influence their job prospects over a business dispute.

Third one could be a possibility, but this can be addressed in the future by jumping through an extra hoop. Plus, I don’t think this really changes anyone’s opinion of Bud Adams.
