Reggie Bush to finally give his deposition

Let get this done...

From the OCR:

Heisman Trophy winner Reggie Bush has been ordered to give a deposition next week as part of sports marketer lawsuit against the former Trojan running back.

San Diego County Superior Court Judge Steven R. Denton ordered Bush to give a deposition April 23 in the latest step in a scandal that has left the Trojan program facing NCAA sanctions in part because of charges that Bush and his family during his playing career at USC received nearly $300,000 in cash and gifts in violation of NCAA rules from sports marketer Lloyd Lake.

Lake is suing Bush in San Diego Superior Court to recover the financial support he provided Bush.

"Now the truth will finally come out," said Brian Watkins, an attorney for Lake.

A USC spokesman declined comment.

Denton on Tuesday also cleared the way for Michael Michaels to give a deposition in the suit on April 21. Attorneys for Bush had tried to block the Michaels’ deposition claiming it would violate a confidentiality agreement between Bush and Michaels as part of an out-of-court settlement.

I will be happy when this is finally over.

It has gone on far too long...

No doubt

Lake’s attorneys are pushing for the deposition before the NCAA ruling on USC. Once that happens they have lost most of their leverage.

Well, now that the NCAA can look at a definitive date for the deposition before they must rule

What incentive would they have to make their ruling before the deposition? Unless it somehow gets pushed back again, I don’t see the NCAA verdict coming out in the next week. If they don’t find out anything new from the depo, then they may just release the verdict straight after, but I wouldn’t be surprised to see the verdict come out closer to the 10 week mark.

There might be a timing problem for the NCAA.

Pretty sure they have a specific time frame in which to hand out their ruling after meeting with USC.

Yeah

I was under the impression that they had to rule within 6-8 weeks, not 6+, but I could easily be wrong.

Because he is the plantiff Lake HAS to go first

He has stalled before…would not be surprised if he stalled again.

That could have some serious repercussions with an already pissed off judge…

Paragon, I don't think you're correct about whose deposition goes first

Generally, Plaintiffs do give their depositions first, but there is AFAIK no rule that requires Plaintiffs to be deposed first. Also, the deposition date (or the deadline for completion) is being set by the court after several continuances and a court ruling on the timing, so I doubt that it will be continued again unless something major develops.

AFAIK??

Don’t think it will be continued but I am 99.9% sure Lake has to go first with some atty’s I have spoken with off the board…both USC affiliated and non-USC affiliated.

I practiced for seven years in California before moving to Chicago in 2001

including San Diego, and there was no local rule at the time that required a plaintiffs’ deposition before the defendant’s. I just checked the CCP and there is no statutory requirement that a plaintiff go first. In Chicago, there is no stautory requirement nor is the order of depostions addressed in any local rule. Usually, plaintiff goes first but there is no hard and fast requirement.

Not flaming here.

Depositions or no

I read in a San Diego paper that Lloyd Lake can only come up with $864 worth of receipts. All the “other” shit he claims he gave to Reggie’s step-father and stuff for Reggie’s pimped out ride actually came from the accounts of Michael Michaels. It’s because he bamboozled his own mom (Lloyd) and sister out of close to $80,000 for the impetus for getting back at Reggie. Accordingly, Reggie’s defense team can counter any other paper trail or false documentation that Watkins is trying to put over on the courts.

Does that make it any easier on us, as it applies to what Reggie Bush’s family was up to? No, absolutely not.

But what this shows is Lake’s frivolous lawsuit is entirely without merit. (he shoulda got on Michael’s money train when it was in court on the first go-round).

When Lake gives his deposition it will finally provide the judge with just cause to dismiss this case. That, or when Michael Michaels gives his testimony in this deposition stage.

Dismiss

yes just keep telling yourself they are going to dismiss this and USC will be cleared. Too much time and money have already been invested by the NCAA for this to go away. There would be such an uproar, plus the NCAA would come off looking like the stooges they really are. Good luck with that.

I don't think they will dismiss

even if USC coaches or admins weren’t involved at all, I still think the NCAA sanctions us. I believe that they are totally aware that the PR would be so bad if they let USC off the hook. One thing I have learned over the years is never underestimate the inconsistency of the NCAA.

I never said they would dismiss...search feature is your friend

in fact I am on the record as saying that because it has been so long the NCAA has no choice but hand some sort of punishment down.

I guess misery loves company right…guys like you can’t wait for SC to go down so you won’t feel as bad with own history…

Lake v. Griffin, Bush, et. al- as a court case getting dismissed is . . . . . . . .

. . . . .just a tad-bit different than the lyin’ goin’-around trying to find the person who said “and USC will be cleared”! No one here has proposed or said that USC will be cleared by the NCAA in the Bush/Mayo investigation. Our day of judgment will come, and punishment and probably penalty will more than likely happen for USC.

Oh yeah, and. . . as far as, "how the NCAA big-wigs feel about themselves and their ‘public-perception problem(s)’ "? Uhhhhhh?

They don’t.

They don’t “feel” anything. And you know what? They also pretty much don’t care one iota, how Joe Blow feels about “The NCAA” either. They could care less. (even if THEY COULD CARE? they wouldn’t. )

So Bix

You really think that these guys investigate for 5 years, come up with zero, and have the cajones to let USC off the hook? I just don’t see it.

by frak on Apr 16, 2010 7:52 AM PDT up reply actions

The efforts the NCAA had to undertake to investigate USC throughout this whole affair. . .

. . . . is inconsequential, yes. Both in cost and man-hours. Granted, the NCAA might not have exactly “budgeted” correctly, in preparation for this investigation, but INVESTIGATIONS are what they essentially do. Yeah, they provide oversight, legislation, organization, and what-have-you for their member institiutions. And they’ve been known to throw a seminar or two or host lavish parties for their big-wigs, but primarily. . . . .I know of no other real function or means of revenue outside of enforcing and investigating NCAA bylaws and codes.

I’ve hardly been convinced, especially throughout these investigations, the NCAA pays any attention to what the public thinks or that public-sentiments have any bearing on the outcome and determinations of their investigation. I"m sure they’ll use any available credible and verifiable source for info or documentation (and that includes the courts and public records)- but as far as them thinking, “Gee, we’ve been on this for some time haven’t we? We’d better hammer them hard for making us do all this work!”

We’ll get what we deserve. The NCAA only wants their institutions to clean up their act, remedy the violations/violators and get back into compliance, and stay the fuck out of trouble in the future.

If this Bush/Mayo investigation took only 4months to fully investigate- is it your impression that the NCAA would hand down a lighter-sentence/punishment?

I never said USC is going to get let off the hook. We’re looking at serious violations!!! It’s gonna come down to WHAT they know, WHO was involved and to what extent, and WHO & WHAT they find to be credible in all this.

fwiw: the NCAA has already come up with some stuff they believe to be true and credible, they’ve got WAY MORE zero here. They had it before USC had to face the infractions committee.

For one thing the ncaa is bunk in my book since they screwed me out of Eligibility.

Those Fookers can go Fly Over The Iceland Ash for all I care, yah they will hit USC with something. But as Bix says the time line shouldn’t matter they are the ones taking so long to Flush and believe they are full of it. They take there dam time on all matters, think of all the delayed eligibility decisions.

This all a bunch of CRAP anyhow so what happens——Happens.

Well I would write something but I can't think of anything, so GO ME.
