No Arbitration for Reggie Bush...
I will be happy when this is all over...
After a long delay in the Bush case, the decision handed down Monday could unlock key testimony and evidence in the NCAA’s ongoing investigation against USC.
The NCAA is looking into whether Bush or his family received improper benefits from sports marketing investors, including the free use of a house in Spring Valley. Now that Bush’s appeal has been denied, key depositions will be attempted to be taken by attorneys for Lloyd Lake, who sued Bush and his parents in October 2007, seeking almost $300,000 in cash and goods he said was lent and spent on their behalf. Bush's attorneys dispute this and still will try to have the case thrown out of court for lack of evidence.
While I still think SC is in the clear because they could not have known about an arrangement that was happening 100+ miles away SC image is further hurt by having Pete Carroll have to sit for a deposition.
That only hurts USC's image more.
For the life of me I just don't understand the settlement with Michaels but not with Lake...Lakes testimony is not the issue, its Michaels settlement. A deposition will bring Michaels settlement to light and because he was the money man that is all the NCAA will need.
I am not buying the whole extortion thing...because Lake has never been charged with it, regardless of his background. Heck, 300K to Michaels is pocket change. Double that and split between the two of them and it is still less than all of the legal fees AND money owed that he will end up paying.
We all know his family took the money. They could care less about SC and they could care less about what anyone thinks about them. They just got greedy...
I never thought that Bush would win arbitration. I knew this was only a delay tactic. I really only care about SC not Reggie...he bailed and has left SC holding the bag.

I totally agree
The extortion thing has no wheels on it. Apparently, Lake’s mom (a real estate professional) and his sister (Lisa, a San Diego area TV anchor woman) invested close to 90K between the two of ‘em for their son/brother and his fledgling business partnership with Michaels in New Era. As I was investigating some of this stuff tonight- it dawned on me that maybe, just maybe Lake is looking to recoup the losses suffered from his family’s investment.
Now, did all that 90K go directly to Bush? (doubt it). Did Lake use some of that 90K to lavish Bush and the Griffins? (probably, but that’s on his dime- he was the one wooing in the first place). Does he have a paper trail for any of this that has his name, his mother’s, or his sisters? And if so, are these not ‘expenses’ doled out on a ‘Chart of Accounts’ instead of an ‘IOU’ or a ’player’s handshake deal’? (maybe and yes, respectively).
The fact of the matter is, Reggie Bush is a prick. I love the guy when he was in a Trojan uniform, but he’s allowed the smattering of USC’s image to go on and on with all this BS. Is it totally out of his perspective to settle this out of court with Lloyd Lake? And even though Lloyd Lake seems to be like vermin, there’s an Aesop’s tale in here somewhere. You know- the Rat and the Lion (little things with great power) and the Gnat and the Lion (being undone by, yet- even smaller things). Bush is silly to think this guy is or was gonna go away- and at what cost? His reputation, our beloved institution’s, and the court of public perception.

There is a precedent
When an agent gives money to a player, in the past the NCAA has been more lenient than when a booster gives money to a player. When an agent is involved, there is a chance that the NCAA could only punish Bush, by declaring him ineligible. USC would be forced to forfeit games that he played in, but wouldn’t lose scholarships, etc.
It is clear to mostly everyone that Reggie and his family received extra benefits. The NCAA might not deal a harsh blow to USC because it happened 100+ miles away with agents having nothing to do with USC coaches, administration, fans, or boosters.
The big question is whether USC should have known or could have known what was going on in San Diego. Running backs coach McNair met Reggie down in San Diego and Lake alleges that he must have known that something was going on. The difference between what happened with USC and Oklahoma is this:
Oklahoma had multiple athletes working at a dealership in Norman, formerly owned by a OU booster, that reported their timecards to the athletic department. The timecards showed time at the dealership when OU football players were at practice. It was an easy discrepancy to find.
USC had 1 athlete’s parents move into a house in San Diego with money given to them by a businessman looking to start a sports marketing company.
The OU problem was right under their noses in Norman. USC would have had to hire a PIs to find out what Reggie’s family had been up to.
I think SC's problem
will be once you add together the Tim Floyd problem, the Bush saga AND now Mcknight you come to the NCAA’s favorite… “Lack of Institutional Control”..Thats a big one cause it doesn’t matter if USC knew about Bush being paid..its about the fact that they should have known. They hit bama with this one over the text book “scandal”. They said we should have known that athletes were abusing the system.
But, i just find it hard to believe that SC had no idea what Bush was up to. I don’t have any facts to prove this and its just my opinion…but come on..SC had to know that their biggest star was getting paid under the table..
Alabama is so on top of things these days, that it suspended its star LT before last years Sugar Bowl just because one of his relatives might have had contact with an agent, self reported the text book thing, self reported the so called “boating trip” that Julio and Ingram took over the summer and suspended one of our LB’s for nearly half the season over some alleged contact with an agent that eventually was cleared…Whats my point? These days, you better have your shit straight…

SC is not going to try and a track the movement of every players family members. Privacy issues aside where is the justification?
Agents or would be agents are different than Boosters as we have seen in Norman and Tuscaloosa in the past.
The NCAA combined the issues because they had nothing when taken on their own merits. Bush and Mayo aren’t talking. I think SC has less of an issues with Bush than it does with Mayo because the guy who brought Mayo to SC was a known bad apple from his past dealings at SC.

But ‘Bama suspended him for the same reasons that McKnight wasn’t cleared….to ensure that the NCAA knew they were policing their own program.

I hear what you’re saying. The SC “scandal” is not a cut and dry…at least in the NCAA’s eye. If no one is talking (except the guy suing) then its kinda hard to build a case. Now, in the court of public opinion, SC is already guilty. No i haven’t seen all the facts but there is enough fishiness going on to show somethings not right at SC.

BTW there is a California law in place to protect theses kids…

this is key. SC really needs to drop the hammer on Lake, Louis Johnson, Guillory, New Ere Sports, etc., just as they sued Robert Caron in the Shawn Walters case.
USC needs to fight back against the seedy underworld of agents.
But, to emphasize the point, there has been no evidence made public that USC coaches, staff, or boosters had any participation in, or knowledge of, the side dealings with agents. And, I would add that policing the seedy agent underworld in LA is a much more challenging task than doing it in Tuscaloosa.

that we will receive sanctions. I just hope they are moderate at worst. The NCAA needs to save face after all the media hype and 4 year investigation. They will stick us with something.
It might be a good thing, as many of us want AD Garrett to go.

Dr. Mal Moore took the bull by the horns with Andre. The same cannot be said about the USC AD. He hides behind the tenets of law and legalese and most of us here feel that USC would do better if he were replaced, and soon is not fast enough.
The NCAA can very well come down hard on USC to set a precedent on how things have been handled. As it is, they have their hands tied due to the lack of subpoena power and Garrett’s sheer will to see that these situations fall on their face and die through the courts.

And this is whats wrong with the NCAA. Its not fair and its definitely not balanced. They made an example of Alabama…but let other programs like OU get by with little more than a slap on the wrist.
Thats why most fans outside of SC want you guys to get hit…not because of jealousy ( i think Alabama is doing just fine thank you), but because we feel that SC has gotten away with a lot more because you are SC..

one came at the end of the year (UCLA) which is the worst time to lose and the other (’08) was because there were better teams ahead of you.
How if the Pac-10 had a conference championship game..USC might have played in the NCG last year…but thats a discussion for a different day. :)

and seriously bam- not to split hairs, but something must be said about the whole ‘being paid’ deal.
frak outlined what being paid really and truly is, under the spirit of the NCAA bylaws. but even still, ANY ADDED benefit- be it financially, hotel/tix/airfare for athlete or his/her friends and family is still considered a benefit. (though not necessarily ‘being paid’) It’s quite easy to just blanket write/say ‘being paid’ but under what auspices is it being construed? and in Bush’s case- if you take the phrase semantically- what dollar amount?
Bush had a pimped out Impala and he may have been given some airfare and hotel lodgings that tie him directly to Lake. Receipts for the Impala’s improvements have not been offered in discovery nor has any paper trail detailing anything close to the 90K Lake supposedly owes toward his family. His whole $300K is way off base and is more of a punitive amount, as even if he does win his case- he will not get any attorney fees rewarded (also in the appellate judgments yesterday- there were 2: private arbitration bound to all parties have been dismissed, as it applies to the Michaels settlement. And no reward of monies owed to Lakes attorneys for having to argue at the appeal level and possibly at the jurisdiction level)
At worst, testimony under sworn oath is the best that Lake can achieve right now. Any jury in their right mind will not allow judgment in his favor for the amount that he wants. It’s the sworn testimonies that any/all compelled parties must submit to on the USC side (re: Bush, Carroll, USC AD Garrett, et. al) that will be the dagger and cause most damage as the investigations that are tied to OJ Mayo, Bush, and now McKnight driving his girlfriend’s SUV that was actually owned by a Santa Monica businessman are under the umbrella of “Lack of Institutional Control”- as far as the totality of the NCAA investigation.
Being paid is a poor man’s argument that supposes USC athlete’s aren’t amateur. You know and I know that is full of shit.

If these things play out the way Lake’s lawyers want it to play out, USC will face a harsh judgment. And rightly so, unfortunately.
I did some reading on this subject last night, and from what I’ve found out regarding the illegal taping of Lake and Bush with his step-father- it doesn’t look good. Which is why I was stopped dead in my tracks for posting a fanpost on this. The fanpost was looking very anti-USC, and that is something I do not wish to do here on my beloved Conquest Chronicles. I love RBR too, and I’d stop myself from doing the same thing over there if it were the same circumstances.
It doesn’t look good if Cromwell (Bush’s lawyer and point man on his legal team) cannot quash this Lake v. Griffin case. He’ll try to force a summary judgment which will entail lack of evidence for the trial to move forward as Lake’s legal team has not provided a substantial paper trail (documents outlining his dollar amount and investments). Even still, if they do provide the necessary paperwork- they will try to either counter-sue or bring charges against Lake because it is illegal to compromise the amateur status of active collegiate players here in California.
It’s a mess, and it’s gonna get worse.
